Why the Helicopters Mattered More Than the Object

Why Attribution Failed Despite the Sightings
The central problem was that recognising a helicopter type is not the same as identifying an operator.
Even if the aircraft were Chinooks, that fact alone did not establish ownership by a specific federal agency. Chinooks were flown by multiple military organisations, including Army and National Guard units. Determining responsibility required evidence such as flight records, mission documentation, unit logs, pilot testimony or other official records linking a particular government organisation to the reported event. The legal standard was also stricter than the standard for a UFO report. The witnesses did not need merely to show that helicopters were present. They needed to show, by a preponderance of the evidence, that federal employees operating federal aircraft were responsible for the events that allegedly caused their injuries. The court concluded that the plaintiffs had not met that burden. Judges found insufficient evidence that either the helicopters or the unidentified object belonged to or were operated by the United States government.
